PSH Worker Terms of Service

Version 1.3 · last updated: 29 September 2026

This is a translation provided for information only. The legally binding version is the Polish one: /regulamin

These Terms of Service set out the rules for the provision of electronically supplied services within the PSH Worker system – the website worker.pshu.pl, the company panel panel.pshu.pl and the PSH Worker mobile app. These Terms are the terms referred to in Art. 8 of the Act of 18 July 2002 on the Provision of Electronically Supplied Services (ustawa o świadczeniu usług drogą elektroniczną).

These Terms are made available free of charge at https://worker.pshu.pl/regulamin in a form that allows them to be downloaded, stored and printed.

§ 1. Service Provider and definitions

Service Provider – PSH Usługi Sp. z o.o., ul. Przemysłowa 47, 22-100 Chełm, tax ID (NIP) 9223067313, e-mail: support@pshu.pl. The company's registration details are given in the Legal notice.

  • System / Service – the PSH Worker software made available as SaaS: the employee mobile app, the company panel in the browser and in the mobile app, and the server-side functions.
  • Customer – a business (a natural person conducting business activity, a legal person or an organisational unit without legal personality) that has concluded an agreement with the Service Provider for the use of the System.
  • Company Account – the Customer's separate space in the System, identified by the company code, together with the Users' accounts.
  • User – a person using the System under an account assigned by the Customer (boss, person with panel permissions, employee).
  • Company boss – the User with the boss (owner) role of the Company Account, indicated during registration or in the order, who is authorised to make statements in the panel on behalf of the Customer, including cancellation (§ 4).
  • Platform administrator – an authorised member of the Service Provider's staff who handles Company Accounts and technical support; every time the platform administrator enters a company panel, this is recorded in the audit log visible to the company boss.
  • Client – a business partner of the Customer to whom the Customer has provided a password-protected link to the client portal.
  • Plan – a variant of the Service defined by the limit of active employees recording working time, in accordance with the price list.
  • Subscription Period – one month, paid for by the Customer in advance; successive Subscription Periods follow on directly from one another.
  • Data Processing Agreement – the personal data processing agreement constituting Annex 1 to these Terms.

§ 2. Types and scope of services

The Service Provider provides free of charge: access to the content of the website worker.pshu.pl, the contact form, the company registration form and the login form, as well as the client portal (for persons to whom the Customer has provided the link).

The Service Provider provides for a fee – under an agreement concluded with the Customer – access to the System in the chosen Plan, in particular:

  • working-time registration (punches with server time and – if the Customer enables it – GPS position), hours calibration and adding missing punches,
  • end-of-work reminders (for employees with set working hours) and handling of employees' punch correction requests,
  • working without signal: tasks and photos saved on the phone and sent once the internet connection is restored and – once the Service Provider makes this feature available (notice in the panel, under Configuration) and if the Customer enables it – offline punches in the Android app, with the time determined by the server and each such punch accepted by a supervisor,
  • management of employees, permissions, groups (from the Ekipa plan), working hours, leave and days off,
  • the punch map, location checks, work sites (zones) and the work site switcher,
  • tasks on a map with photos, clients, the client portal and preparing reports to be sent by e-mail,
  • reports and export (CSV/XLSX), export to HR and payroll software (universal CSV/XLSX format and the Customer's own templates), export of the Company Account data, the audit log and module configuration,
  • an information notice generator for employees, together with a register of acknowledgements that they have read it,
  • login to the panel with two-step verification (2FA), technical support and updates.

Plans differ only in the limit of people and the availability of groups (the Start plan does not include groups). The Customer decides which modules to enable in the Configuration tab. The Service Provider may develop the System, add features and change the interface without limiting the essential features of the paid Plan.

The export to HR and payroll software prepares data on working time, breaks, night work, work on Sundays and public holidays, and absences according to the settings chosen by the Customer. The System does not calculate overtime or remuneration – settlement is the responsibility of the Customer and its HR and payroll software. The Service Provider prepares file templates for specific HR and payroll programs on the basis of the documentation published by the producers of those programs and marks them in the panel as prepared on that basis; before the first import, the Customer performs a test import and checks its result.

§ 3. Technical requirements and risks

To use the System, the following are required:

  • a device with internet access and an up-to-date browser (Chrome, Edge, Firefox or Safari) with JavaScript and browser storage enabled – for the website and the panel,
  • a phone running Android 8.0 or later – for the mobile app; on an iPhone with a current version of iOS, the app can be run in the Expo Go app as a test version made available by the Service Provider (without offline punches),
  • internet access on the phone at the moment of punching – unless the Customer enables offline punches once the Service Provider makes them available (Android app only); tasks and task photos can be saved on the phone without internet access and sent once the connection is restored,
  • a GPS module with precise location enabled – at the moment of punching, if the Customer has enabled location collection,
  • an authenticator app generating TOTP one-time codes (e.g. Google Authenticator, Microsoft Authenticator, Authy) – for every User with panel permissions (boss, deputy, manager, accounting and other accounts with panel permissions),
  • an active e-mail address – for the company boss.

The Service Provider advises that the use of electronically supplied services involves typical risks such as malware, phishing for login details, interception of transmissions on unsecured networks and unauthorised access to a device. The System encrypts transmissions (TLS); however, Users should protect their passwords and the devices with their authenticator app, not share them with others, install the app only from the link provided on the website worker.pshu.pl or in the app, and keep their devices' software up to date.

Providing unlawful content to the System, including content that infringes the rights of third parties, is prohibited.

§ 4. Conclusion of the agreement and cancellation within 14 days

Only businesses may conclude an agreement for the use of the System. The person completing the registration form or placing an order via the contact form declares that they are authorised to represent the Customer.

To conclude the agreement on your own, complete the Sign up form: choose a Plan, provide the company and boss details (including an e-mail address), the company code, username and password, choose a payment method and accept these Terms and the Data Processing Agreement. The System records who accepted these documents, when and in which versions.

The agreement is concluded when the Company Account is created, which the System confirms with a message on the page and by e-mail. The account works immediately.

The Customer may also order the Service via the contact form. In that case, the Service Provider confirms the order by e-mail with links to these Terms and the Data Processing Agreement, creates the Company Account together with the account of the company boss indicated in the order and provides the login details. On the first login to the company panel – in the browser or in the mobile app, after setting up two-step verification (2FA) – the company boss accepts, on behalf of the Customer, the current versions of these Terms and the Data Processing Agreement, and the System records who accepted these documents, when and in which versions. Until this acceptance, the company boss cannot use the company panel. The agreement – together with the Data Processing Agreement – is concluded at the moment of this acceptance. If the company boss does not accept these Terms and the Data Processing Agreement, the agreement is not concluded – upon a request sent to support@pshu.pl, the Service Provider deletes the Company Account and refunds the payment made for the order in full.

Cancellation within 14 days with a full refund

The Customer may, without giving any reason, cancel the Service by terminating the agreement with immediate effect within 14 days of the day on which the agreement was concluded – regardless of whether the agreement was concluded via the registration form or via the contact form, and regardless of the payment method. The period is counted from the day following the day on which the agreement was concluded (the creation of the Company Account or – for an order via the contact form – the acceptance referred to above) and expires at the end of the 14th day (Polish time), even if that day falls on a Saturday or a statutory public holiday (subject to § 12); the System shows the expiry date to the company boss in the panel.

Cancellation may be submitted:

  • in the company panel – using the “Cancel with full refund” button (Configuration → Subscription), which is available only to the company boss and is displayed, together with the expiry date, until the end of the period; before confirming the cancellation, the company boss may download an export of the Company Account data; a cancellation submitted in this way is deemed to have been submitted on behalf of the Customer,
  • by e-mail – by sending to support@pshu.pl, before the period expires, a statement made by the company boss (from the e-mail address stored in the System) or by a person authorised to represent the Customer.

Effects of cancellation:

  • the Company Account is closed immediately after the cancellation is confirmed in the panel, or without undue delay after receipt of the statement sent by e-mail; Users lose access to the panel and the app, and the Service Provider confirms receipt of the cancellation by an e-mail sent to the company boss's address,
  • the Service Provider refunds all fees paid up to the date of cancellation (usually the fee for the first Subscription Period) and charges no fee for the use of the System up to the date of cancellation; unpaid orders and pro forma invoices (including those issued outside the System for orders placed via the contact form) are cancelled and do not need to be paid, and any payment that is nevertheless received after the cancellation is refunded by the Service Provider in full,
  • the cancellation also ends recurring card payments (§ 5) with immediate effect – after the cancellation, the Customer's card is not charged any further fees,
  • online payments are refunded via the payment provider Stripe to the card or other payment instrument used for the payment, and payments made by bank transfer are refunded to the bank account from which the payment was made,
  • the Service Provider makes the refund without undue delay and no later than 14 days from the date of cancellation (for online payments, it instructs the payment provider to make the refund within that period); the time it takes for the funds to be credited depends on the bank or card issuer. If a VAT invoice was issued for the refunded payment, the Service Provider issues a corrective invoice,
  • the Company Account data (including Users' accounts, working-time records, tasks, photos and files) is permanently deleted without undue delay once 30 days have elapsed since the account's closure, in accordance with § 9 of the Data Processing Agreement; until then, the Customer may request an export of the data by writing to support@pshu.pl. The Customer is responsible for keeping copies of any data that it must continue to retain as an employer (e.g. working-time records and acknowledgements of the information notice). The Service Provider retains data on orders, payments, refunds and cancellations to the extent required by law (e.g. tax law) – the scope and retention period of this data are described in the Privacy Policy.

§ 5. Prices and payments

The agreement may be concluded for the Plans marked in the price list as available for sale. Plan prices given in the price list are net prices for the Subscription Period (one month); VAT is added at the applicable rate. The fee is charged in advance for each Subscription Period.

The Customer may pay by payment card online (via the payment provider Stripe) or by bank transfer against a pro forma invoice. The Customer accepts that invoices are sent electronically to the e-mail address provided during registration or in the order.

Card payment takes the form of a recurring payment (subscription): by providing the card details, the Customer authorises the Service Provider to charge that card automatically, via the payment provider Stripe, with the fee for each subsequent Subscription Period – at its start and in the amount of the price of the Plan applicable in that period – until automatic renewal is switched off or the agreement is terminated. The company boss may switch off automatic renewal at any time in the panel (Configuration → Subscription) or by e-mail sent to support@pshu.pl; switching it off takes effect at the end of the paid Subscription Period – the card is no longer charged and the agreement expires at the end of that period. Card details are processed by the payment provider Stripe; the Service Provider neither receives nor stores full card details. If a charge to the card fails, the payment provider retries it; if the fee for the next Subscription Period is not collected, the agreement expires at the end of the last paid period.

Bank transfer payment: the deadline for paying for the first Subscription Period is 14 days from the conclusion of the agreement (§ 4), unless a different deadline is specified in the order confirmation. The Service Provider sends the pro forma invoice for the next Subscription Period by e-mail to the company boss's address approximately 7 days before the end of the paid period; it is payable by the first day of the next Subscription Period. If it is not paid, the agreement expires at the end of the paid period.

Upgrading to a higher Plan is possible at any time – the new employee limit applies immediately, and the price of the new Plan applies from the next Subscription Period; the Customer pays no additional amount for the current period. Downgrading to a lower Plan takes effect from the next Subscription Period.

The System does not allow an employee to be added or activated beyond the Plan limit, so no additional charges for exceeding the limit are ever made. Apart from the fee for the Subscription Period according to the price list, the Service Provider charges no other fees.

A payment for an order that has previously been cancelled, and a repeat payment for an order that has already been paid, are refunded by the Service Provider in full – online payments via the payment provider Stripe, and payments made by bank transfer to the account from which they were made – without undue delay and no later than within 14 days of receipt (for a bank transfer – of the payment being credited to the Service Provider's account).

In the event of late payment, the Service Provider may, after an unsuccessful payment reminder sent by e-mail, block access to the Company Account. Blocking does not delete any data; access is restored once the payment is booked.

§ 6. Term and termination of the agreement

The paid agreement is concluded for the Subscription Period and is renewed for successive Subscription Periods: for card payments – when the fee for the next period is collected automatically, and for bank transfer payments – once the pro forma invoice for the next period has been paid (§ 5). If no payment is made, the agreement expires at the end of the paid period.

The Customer may terminate the agreement at any time with effect from the end of the paid (current) Subscription Period – by switching off renewal of the subscription in the panel (Configuration → Subscription; available to the company boss) or by sending a notice to support@pshu.pl. In that case, the fee for a Subscription Period that has already started is non-refundable, unless the termination is due to reasons attributable to the Service Provider. A notice of termination or any other statement terminating the agreement that is sent by e-mail within the cancellation period (§ 4) is treated as a cancellation with a full refund, unless the Customer expressly states that it wishes to use the Service until the end of the Subscription Period. Switching off renewal in the panel is not a cancellation under § 4 – a cancellation with a full refund is submitted in the panel using the separate button described in § 4.

The Service Provider may terminate the agreement with immediate effect if the Customer or its Users materially breach these Terms or the law (e.g. attempt to circumvent the System's security measures) and have not ceased the breach despite a request to do so.

The Company Account data is stored in the System until the agreement ends. Before it ends, the company boss may download in the panel an export of the Company Account data (Configuration → Subscription; a ZIP archive with CSV/XLSX files and task photos and files) and CSV/XLSX reports, and after it ends – until the data is deleted – the Customer may request an export by writing to support@pshu.pl. After the agreement ends, the Service Provider closes the Company Account (Users lose access to the panel and the app), and its data is permanently deleted in accordance with the Data Processing Agreement no later than 30 days after the end of the agreement (earlier at the Customer's request), except for data that the Service Provider is required to retain by law (e.g. accounting documents). In the event of cancellation within 14 days (§ 4), the Company Account is closed immediately – the export can be downloaded in the panel before the cancellation is submitted, or obtained on request sent to support@pshu.pl until the data is deleted.

§ 7. Obligations of the Customer and Users

  • The Customer uses the System in compliance with the law, in particular labour law and the GDPR. As the controller of its employees' data, the Customer fulfils its information obligations towards them (including under Art. 13 GDPR) and decides whether to enable location collection on punches and – once they are made available – offline punches.
  • The Customer may use the information notice generator in the panel; it is responsible for the notice's content (including the data it enters into it) and for publishing it. Once the notice has been published, employees acknowledge in the app or in the panel that they have read its current version – without this acknowledgement they cannot record the start of work in the app (a start of work saved offline without this acknowledgement goes to the supervisor for acceptance with a flag; recording the end of work and breaks always works). The acknowledgement documents that the information has been provided and is not a legal basis for processing the data.
  • Decisions on employees' punch correction requests and on accepting or rejecting offline punches are made by the persons to whom the Customer has granted the “Add missing punches” permission; no one decides on their own requests. An offline punch is not included in reports or exports until it has been accepted.
  • The Customer is responsible for the employee identifiers in the HR and payroll software (the PESEL number must not be entered in this field – the System will not accept it), for the export settings and templates, for checking the file before importing it and for passing the file on to further recipients (e.g. an accounting office).
  • The Customer is responsible for the accounts it assigns to Users and Clients, the scope of the permissions granted and the accuracy of the data entered into the System.
  • Users keep their passwords and client portal passwords confidential and protect the device with their authenticator app against access by third parties; if they suspect a password has been disclosed, they change it without delay. A User reports the loss of the device with their authenticator app without delay to the company boss, who may reset the User's two-step verification (2FA), and the company boss reports such a loss to the Service Provider.
  • It is prohibited to circumvent the System's security measures, including by using location-spoofing apps, punching in on behalf of another person, tampering with the app's code, automated data scraping and any actions that may disrupt the operation of the System.

§ 8. Obligations and liability of the Service Provider

The Service Provider exercises due diligence to ensure that the System operates continuously and securely, makes a backup copy of the database before System updates (the rules for keeping it are set out in § 9 of the Data Processing Agreement) and provides updates. Planned maintenance is announced where possible and carried out during off-peak hours.

The Service Provider is not liable for interruptions and malfunctions resulting from causes beyond its control, in particular: failures of telecommunications networks and internet providers, inaccuracy of GPS receivers in Users' devices, loss of data saved on the phone without signal before it has been sent (e.g. after the app is uninstalled, its data is cleared or the phone is lost), force majeure, or use of the System contrary to these Terms. Nor is the Service Provider liable for the course of the import of the export file into the Customer's HR and payroll software, which depends on the settings of that software.

The Service Provider's liability towards the Customer under the agreement is limited to actual loss and to the amount of fees paid by the Customer in the 12 months preceding the event that caused the damage. This limitation does not apply to damage caused intentionally or to cases in which a limitation of liability is not permitted by law.

§ 9. Personal data

The rules for processing personal data for which the Service Provider is the controller (e.g. data from forms and the Customer's billing data) are described in the Privacy Policy, and the rules for the use of cookies in the Cookie Policy.

With regard to data entered into the System by the Customer (data of employees, Users, tasks and Clients), the Customer is the controller, and the Service Provider processes the data as a processor under the Data Processing Agreement, which the parties conclude upon acceptance of these Terms.

§ 10. Copyright and licence

All rights to the System, including the software, graphics and PSH Worker marks, belong to the Service Provider. For the term of the agreement, the Customer receives a non-exclusive, non-transferable licence for its Users to use the System to the extent necessary to use the Service. The app installation file may be made available only to the Customer's Users.

Data entered into the System by the Customer remains the property of the Customer.

§ 11. Complaints

Complaints concerning the operation of the System may be submitted by e-mail to support@pshu.pl. A complaint should include the company name (company code), a description of the problem and – where possible – the date, time and a screenshot.

The Service Provider handles a complaint within 14 days of receipt and sends its response to the e-mail address from which it was sent.

§ 12. Sole traders with consumer rights

The provisions concerning consumers apply to a natural person concluding an agreement directly related to their business activity where the content of the agreement shows that it is not of a professional nature for that person (in particular in light of the business activity disclosed in CEIDG, the Polish business register) – Art. 38a of the Act on Consumer Rights (ustawa o prawach konsumenta).

Such a person may withdraw from the agreement within 14 days of its conclusion without giving any reason – in particular in the manner described in § 4 (using the button in the panel or by a statement sent to support@pshu.pl), and also by making any other unequivocal statement to the Service Provider, e.g. by letter sent to its registered office address; they may use the model withdrawal form set out in Annex 2 to the Act on Consumer Rights, but this is not mandatory. To meet the deadline, it is sufficient to send the statement before the deadline expires. If the last day of the period falls on a Saturday or a statutory public holiday, the period expires at the end of the next day that is not a Saturday or a statutory public holiday – in that case, once the button is no longer available in the panel, the statement may be sent by e-mail. In the event of withdrawal, the person receives a refund of all payments made, in accordance with § 4, and bears no costs for the use of the Service up to the moment of withdrawal.

The limitations of liability in § 8 do not apply to such persons to the extent that they would constitute prohibited contractual clauses.

§ 13. Amendments to the Terms and final provisions

The Service Provider may amend these Terms for important reasons, such as changes in the law, changes in the scope or manner of providing the Service, or security considerations. The Customer will be notified of an amendment by e-mail or in the panel at least 14 days before it takes effect. A Customer who does not accept the amendments may terminate the agreement before they take effect – in which case they will receive a refund of the proportionate part of the fee for the unused period. This does not limit the right to cancel with a full refund in accordance with § 4.

Matters not governed by these Terms are subject to Polish law, in particular the Civil Code (Kodeks cywilny) and the Act on the Provision of Electronically Supplied Services. Disputes with Customers are resolved by the court having jurisdiction over the Service Provider's registered office, subject to mandatory provisions on court jurisdiction.

The Polish version of these Terms is binding; versions in other languages are provided for information only.

Version 1.3 of these Terms applies from 29 September 2026 to agreements concluded on or after that date. For Customers who concluded an agreement before that date, version 1.3 of these Terms (together with version 1.2 of the Data Processing Agreement) applies once 14 days have elapsed since they were notified of the change by e-mail or in the panel; until then, the previous version of these Terms (1.1) continues to apply to them. If, before that period expires, the company boss of such a Customer accepts version 1.3 in the panel or in the app (§ 4), version 1.3 applies to that Customer from the moment of that acceptance. A Customer who, before that date, paid in advance for a 12-month subscription period under an earlier version of these Terms may use the Service until the end of that paid period without any additional fees; subsequent Subscription Periods are monthly in accordance with § 5.
